MUHAMMAD MUSHTAQ versus THE STATE
Article 228 Criminal Code of Conduct (v. 1898), Section 476 Constitution of Pakistan (1973), Article 185 (3) The accused, who was the Deputy Civil Judge's Deputy Counsel, were suddenly admitted to the Chamber without additional permission. He informed that the accused whose request for bail was granted was his sister-in-law. Such an action of the accused was made under Shear 228, PPC read with Section 4776, CRPC. As a result, the conviction of the accused was upheld, but in view of the relaxation, his simple imprisonment was changed to a fine of only Rs 200 and he was sentenced to one month in jail for payment of the fine. Which he had already passed. Appeal for leave to appeal, change in appeal and partial permission was granted accordingly
