The members were appointed as employees of the corporation on a daily wage basis, so it could not be declared a public servant because the current issue involves questions on whether the member was a civil servant or not. Full investigation is required, the same cannot be done in the constitutional jurisdiction, in the presence of clear cut bar for the appointment and selection of Zakat and Government Committees for Government employees, the High Court has appointed the Chairman of the Committee. It was appropriate to decide these matters. The Speaking Order which was approved by the Chairman on appeal was not a speaking order which Haig had set aside. The Chairman was remanded for the decision as the court was illegal.
