GHULAM RASOOL versus MUHAMMAD HABIB
The Special Relief Act 1877 Section 42 Civil Procedure Code (v. 1908), Section 12 (2) Constitution of Pakistan (1973), Article 199 constitutional application suit was challenged on the basis of fraud and misrepresentation under the Decree Order. I was approved to change the landfill in case of a suicide attack on the victim's self-sufficiency in the dispute by the claimant in favor of the defendant on the death of the original owner, challenging him to be near the deceased. Claims and the defendant / defendant to whom the change was approved and has no title. Following the decision of the suit in the dispute, the application under section 12 (2) was filed by the decision-maker, alleging that the decree was obtained by fraud and misrepresentation. What was, the appeal was accepted by the trial court as well as the decision by the appellate court. The constitutional petition challenged both the provisions in accepting the application under section 12 (2), the CPC had gross procedural irregularities which could not be resolved and all proceedings were illegal and in the eyes of the law. The contention was that the decisions of the two courts were set aside and the trial court remanded the case to be decided strictly according to the law.
