MRS. KHALIDA BEGUM versus LAHORE DEVELOPMENT AUTHORITY
The trial court's order sheet for the dismissal of evidence in the Section 42 Civil Procedure Code (v. 1908), A XVII, R 3 suit, revealed that the trial court's order sheet had disclosed that the defendant had to present the evidence. Six occasions were granted, but he failed to present the same plaintiff, despite receiving time as the last opportunity, not only failed to present evidence, but he also failed to appear in court on which the trial court. Closed its evidence and dismissed his claim of unlawful action under OXVII, R3, CPC. The appellate court upheld the trial court's decision, the defendant's adjudication should be postponed to some extent and the court should not have mercy on the prosecution.
