The appellate court dismissed the appeal filed by the petitioner / defendant. According to Article 1212 of the Constitution, administrative courts and tribunals were set up with special jurisdiction. In Article 212 (2) of the Constitution, the matter relating to the terms and conditions of the persons serving in Pakistan has been ordered that no court or tribunal shall approve the injunction, give any order or in relation to any matter. The Khyber Pakhtunkhwa Service Tribunal Act, 1974, enforced in such court or tribunal under the jurisdiction to deal with terms and conditions of concession, was implemented by the Provincial Government for the service of public servants.
