MST. MUMTAZ BIBI versus PROVINCIAL GOVERNMENT OF KHYBER PAKHTUNKHWA

Article 199 Constitution Petition No notice or showcase notice of irregular regular inquiry related to the civil service was given and the applicant was not given the opportunity of hearing before the approval of the unidentified proceeding which was made without hearing. The person whose hearing was against the law of justice and who was employed as a contract-based prosecutor is entitled to clear his / her position and to regulate the relevant competency and disciplinary rules before condemning misconduct. There should be inquiry. The constitutional request was dealt with in the direction of appropriate inquiry.
