MANZOOR AHMED versus CHAIRMAN, AGRICULTURE DEVELOPMENT BANK OF PAKISTAN
Financial Institutions (Recovery of Taxes) Ordinance 2001 requires the bank's claimant to deposit some of the money as per the suit court order by the consumer seeking the account sanction, but he does not deposit any further money. The dismissed plaintiff was that the banking court could not order him to deposit any money, nor could his case be dismissed for such default. The plaintiff's dispute was substantially settled because the plaintiff sought the approval of the accounts, so there was no legal justification that they needed to deposit the money in any way for the right of citizens to recover. A ban is imposed which led to the High Court accepting the appeal and setting aside an unconstitutional order, which would result in the case being adjourned before the Banking Court to decide on the merit in accordance with the law.
