GENERAL MANAGER/CIRCLE EXECUTIVE MUSLIM COMMERCIAL BANK LIMITED versus MEHMOOD AHMED BUTT
Supreme Court Rules 1980 Os Os OS XXVI, R 1 & O XXXIII The Appeal Court directed the applicants to pay respondents service benefits from 12 12 1988 to 9 9 1997. Revised which caused the defendant to commit fraud on the court. In 1989, hiding the fact of emigration to another country and having no plans to return to Pakistan settled there, thus, he was not entitled to the benefits of service for the period except the applicants. Not to set a record or even to indicate that the respondent had been abroad or resided during all these years and had said that he had no intention of returning to Pakistan. The mere verbal statement of the survivors could not be effected. The country went abroad without any proof that he was doing a favorable job during that period, nor was it sufficient to deprive him of the benefits of the services, nor absent such evidence, It can be assumed that he committed any fraud on the court review petition, he was dismissed in the circumstances.
