FAQIRULLAH versus THE STATE
Kalashnikov's recovery from the defendant accused of defining section 132 of the Pakistan Penal Code section 302 (b), criminal code of conduct (v. 1898), section 103 of the West Pakistan Arms Ordinance (XX of 1965), P.C. PK's crime was retained for four and a half years by the investigating agency and after Kalashnikov's recovery was sent to a ballistic expert, highly suspicious eyewitnesses were not present at the match with the rifle. It seems that this incident happened much later when the FIR revealed that in the absence of any material evidence against the accused, his heinous crime could not have led to his conviction and the accused. Was acquitted under the circumstances.
