A. XLI, R 18 Appeal for non-availability of declaration fee as per the order of Section 42 of the Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974) was dismissed. Before the High Court, the order was filed in the order dated 3 10 2001 that it was not present before the court in that date, as it had no knowledge that their clients were responding by order. An order fee submission was ordered to affect the service of which no counter affidavit was filed. For the respondents whose presence was recorded on that day, the order of dismissal of the respondents was not sustained, the court accepted the appeal and fixed the improper order which resulted in the appeal of the appellants.
