MUHAMMAD BAKHSH versus THE STATE
Section 497 Criminal Procedure (XLV of 1860), Section 302 bail, FIR grant was filed after two months and thirty days, and the accused was not charged with killing the deceased and was unauthorized. Even if the chemical report was to be believed, anyone could have poisoned the victim, but the complainant had not seen the crime committed. Samples taken from the body of the victim were received in the chemical laboratory five days after his departure, raising serious doubts. The authenticity of the laboratory certificate, even if it was accepted that the victim was poisoned, still had to prove that the accused had been granted bail under the circumstances.
