M. HANNAH versus ANWARUL HASSAN
The Special Relief Act 1877 Section 12 Civil Procedure Code (v. 1908), O VII, R 11 Limitation Act (IX of 1908), Section 14, and Article 113 suits were dismissed on the basis of the specific performance of the contract limitation. The case was stopped under Article 113. The plaintiff of the Limitation Act, 1908, was earlier trying to move different courts in search of different reliefs and in most cases returned claims that the court had no jurisdiction to grant the desired relief. Was to be filed within three years, but after the expiry of the stipulated period, the plaintiff did not show that relief was sought in the suit in the earlier suit so as to benefit from Section 14, the Limitation Act, 1908.
