The authority was that the Provincial Service Tribunal had no jurisdiction to decide the matter and only the Federal Service Tribunal Had jurisdiction over the matter. The legal dispute in this case could not have been due to the lack of jurisdiction of the Provincial Service Tribunal as the decision of the Provincial Service Tribunal was postponed. He assumed the jurisdiction with which he was not barred. Appeal was allowed and the case was remanded.
