WAPDA versus ABDUL HAFEEZ KHAN

Article 12 (1) (c) Punjab Service Tribunals Act (IX of 1974), Section 4 (i), Prodiso (b) Employee of Provincial Government serving on Deputation in Wapda Provincial Service Tribunal, jurisdiction of the terms and Refusal of Terms of Service A high-grade civil servant was a provincial government employee but has been operating in Wapda since 1959, the deputation authority refused to grant him a higher grade, which was filed before the Service Tribunal. The authority was that the Provincial Service Tribunal had no jurisdiction to decide the matter and only the Federal Service Tribunal Had jurisdiction over the matter. The legal dispute in this case could not have been due to the lack of jurisdiction of the Provincial Service Tribunal as the decision of the Provincial Service Tribunal was postponed. He assumed the jurisdiction with which he was not barred. Appeal was allowed and the case was remanded.
