Sections 44 and 47 of the Azad Jammu and Kashmir Interim Constitution Act, 1974 and the Civil Service Appointment Appointment Order whereby the respondent was appointed in a direct writ petition, the authorities stated in their written statement by notification to the respondent's appointment order. It was withdrawn and that service was told by the respondent that the notification was not challenged by the respondent, after which the certification was submitted by the authority. That a summary action was taken by the Authority in which it was sent that the petitioner could be badly affected, the prohibited writ should not have been issued by the High Court.
