NUR ALAM versus SPECIAL JUDGE, PREVENTION OF SMUGGLING ACT, 1977, N.W.F.P., PESHAWAR
Sections 31 and 43 of Pakistan Smuggling Act, 1977 (Article 1973), Article 199 Constitutional application to maintain the applicant is interfaith and legal under section 31 of the Prevention of Trafficking by Imported Notice / Order Special Court. The reason given is that the right of appeal provided under section 43 of the said Act is a cure for them, not a hearing petitioner who was a close relative of the main smuggler against whom the Anti Narcotics Task Force filed Detailed information about its involvement in trafficking was provided to the nearest association. Without smuggling in front of a special country along with other well-known smugglers, the smuggler approached the High Court to file a constitutional petition. Petition was being controlled through the Inner Investigation into such information and allegations that may be required only through a trial court case whereby the property in the name of the applicant is still present before the special court. Where he will have ample opportunity to prove the property. His name was not obtained through smuggling assets but constitutional application was rejected by law in the circumstances.
