ASHIQ ALI versus MEHAR ELAHI

Sindh Rented Prices Ordinance 1979 Sections 15, 16 (1) and 16 (2) of the Constitution of Pakistan (1973, Article 185 (3)) are defending the default as per the order of the rent controller on account of rent arrears. Submission of monthly rent in the rent controller instructed the tenant to submit the rent arrears to the court but the amount was not deposited at which the tenant controller abolished the tenant's defense and the High Court dismissed it. It also removed the order of eviction - there was no jurisdiction to review the complaint filed by the tenant that the tenant had approved by the controller. The terms of the order do not collect the arrears and future rent for the tenant. There was no technical point in complying with this order and in which the Supreme Court refused to interfere. The conclusions of the two courts below were rejected
