Such a trial was filed against a man by a woman on the basis of section 5 of the West Pakistan Family Court Act 1964 and the Schedule to the Constitution of Pakistan (1973), Article 199 constitutional petition suit. The lower appellate court allowed the appeal and the jurisdiction was dismissed. The lower appellate court disregarded the fact that the evidence on record was false to prove that the woman was his legally married wife on the person who claimed to be her husband and so on. As such, he dismissed the decision, calling himself the wrongful alimony. And the trial court's ruling and the lower appellate court's ruling were without legal authority and were set aside.
