Rule 1908 Section 12 (2) Final Decision If the Supreme Court denies leave only and affirms the decision or order of a High Court, the final decision under Section 12 (2) shall be the High Court and not the Supreme Court, If the Supreme Court rejects a High Court decision and records a decision on a question of fact or law which the High Court had, then the final decision or order will be the Supreme Court. For purposes of section 12 (2), CPC.
