AZAD JAMMU AND KASHMIR GOVERNMENT versus TARIQ FAROOQ


The R34 Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974), appeals to the Supreme Court of Article 42 to approve the interim relief. Respondent challenged the Accountability Act 1997 in his constitutional petition filed before the High Court and action was taken against him under the said Act. The High Court accepted the constitutional petition and granted interim relief to the respondent without issuing the required seven days notice under R4 of 1984 of the Azad Jammu and Kashmir High Court (Code of Conduct), according to law. The applicant / applicant has clearly given the interim relief. The Supreme Court vacated the illegal interim relief granted to the respondents with the instruction that the application for interim relief transferred by the respondent / applicant in the High Court be considered pending.
