Dastur Pakistan 1973 Article 185 (3) Appeal for delay in filing leave for appeal has been delayed for sixty days from the applicant on three grounds. First, he could not contact his lawyer because there was no telephone facility. Secondly, the applicant was confined to the bed, and third, that the applicant's lawyer lacked telephone access, there was no reason for the delay, as the applicant was obliged to take his case. Diligently follow up and he was responsible for his lawyer's negligence. There was no basis for waiving the delay in limiting the applicant to RBD, as he could not be allowed to take advantage of his bald statement in this regard; there was no evidence on record and lack of funds. In the meantime, it would not be permissible to request a delayed concession pending a leave request - the absence of any reasonable ground for a late condolences was timely barred.
