Clause 4 of the Service Tribunals Act 1973, Pakistan (1973), Arts 199 and 212 constitutional petition bar was challenged by the applicant's service tribunal constituted under Article 212 of the Constitution, under the jurisdiction of the preliminary appointment. At the time of first admission, the post does not compliment the terms and conditions of a public servant. Applicants did not dispute the appointment of a defendant on the basis of any incident thereafter in the matter before the service tribunal.
