BOARD OF INTERMEDIATE AND SECONDARY EDUCATION, FAISALABAD versus RIAZ HUSSAIN
Employees of the Intermediate and Secondary Education Board, Faisalabad Service Regulations Chap IX, Reglns 11, 18 and the Czech XX Civil Procedure Code (V8 1908), Section 115 question whether the employees of the Board are subject to the rules of utility and discipline. The courts, ignoring the differences between litigation and the rules, rejected the suit and appeal. Departmental directives without the approval of provincial or central government influence were sought without any basis to ascertain the merits of the case on which to adopt rules of competence and discipline. It was requested that such an inquiry was negligent in regard to the law and regulations framed by the High Courts. Was conducted fairly and the inquiry officer had sufficient material to maintain the conviction. In the appeal by the lower appellate court, the results of the reconsideration were dealt with on the basis of material misconduct and non-consideration of the material available on record.
