AMEER versus PROVINCE OF PUNJAB
The Special Relief Act 1877 was a matter of dispute between the parties for a permanent injunction under section 10 of the Civil Procedure Code (v. 1908), section 9 of the West Pakistan Government Land and Buildings (Recovery) Ordinance (IX of 1966), section 10. The property title to the property in dispute has been proved by the proceedings, revenue records and evidence presented by the plaintiffs in respect of the three properties in the property that the plaintiff was the owner of the property without any objection from the defendant authority. Was not prosecuted for the delimitation proceedings. Only a civil court can resolve a legal dispute between the parties regarding the property and title to the property, and section 10 of the West Pakistan Government Land and Buildings Ordinance, 1966, authorizes the civil court to entertain this case.
