The Council Appeal was to be decided by the Appeal Committee consisting of 3 to 5 members under R3 (IV) of the Pakistan Bar Council Appeal Rules 1986, but the Chairman Appeal Committee sat alone and tiled the request through the Respondent. And was approved by a suspended order. Executive Committee Punjab Bar Council, under which the applicant was announced to be the President of the Bar Association, in which the matter of appeal for delivery of interior or interim relief had to be dealt with by a committee consisting of 3 to 5 members and Every order or decision of the committee was to be taken. According to the majority opinion of the members provided by R5 of the Pakistan Bar Council Appeal Rules 1986, the Appeal Committee was inadvertently approved, without legal authority and by a High Court exercising its constitutional jurisdiction. No effect was declared
