Copies of subpoenaed statements of the prosecution's witnesses were filed separately by the Investigating Officer through the Investigation Officer for the provisions of Sections 265C, 161, 162 and 439 of the Criminal Procedure (XLV of 1860), Section 302/324/34. The signature of the prosecution witnesses or the thumbprint of the said additional statements in writing in the case diary will not be constrained by their use as set forth in Section 162, CCPC Trial Court Had acted in gross illegal manner by misusing the provisions of section 161. The CRPC, while refusing to provide copies of the statements of the prosecution witnesses to the accused required under Section 265C, the trial court's CR order was set aside and to provide copies of the aforesaid statements.
