Sections 302 (b), 364 and 201 of the evidence investigations and the manner in which the investigating officer tried to establish the case against the accused had many shortcomings. The co-accused was acquitted. On the basis of the same and consistent evidence and the case is not disputed with the accused, the accused's conviction could not be legally retained, and accordingly the accused was acquitted on the benefit of the doubt.
