STATE versus KHAN WALI
Section 7 West Pakistan Arms Ordinance (XX of 1965), Suppression of Section 13 of the Terrorism Activities Act 1975, was filed after a delay of more than four months until the required entry was filed. Such appeal cannot be sustained. If the limitation period was followed by such an appeal, it had to be disclosed that such delay was due to the action of the accompanying accused or to the compulsory nature of the state appellant's control. This is due to some circumstances which did not ban it. At the time of filing the appeal, the state was unable to maintain the appeal, after being delayed for more than four months, as stated.
