The CPC appeals were rejected on the basis of the CCC Code of Code XLI Original Decisions O XLI, R 30 and Section 96 Limitation Act (IX of 1908), Section 3 first appeal limitation. The first appellate court of law only committed irregularities in excluding appeals. The appeals court should also decide on an appeal on merit to avoid remand, so the first appeal has yet to be decided on the merit, therefore, it will be considered pending before the first appellate court. That the same decision should be made on merit soon as per the due date.
