Article 7 Constitution of Pakistan (1973), Art 199 Constitution of the Election List Act 1974, the selection of a retired candidate as a senator from Punjab was challenged on the ground that he was not a resident of Lahore as a voter in Karachi. He could not have fought the election. A Senate seat from the Punjab Punjab Records shows that the returning candidate had applied for removal of his name as a voter from a particular electoral unit Karachi, which was granted on 11 11 1996. And after that his name was removed from the list, the candidate who returned in Lahore on 27th 11 1996 was registered as a voter in Lahore, which could not be discounted. The Petitioner acknowledged that the returning candidate was the owner of immovable property in Lahore, so, in view of the adoption of the clause in the Election Rules Act 1974 in 5 7, he is a resident. Lahore can legally be registered as a voter there. After the name of the retired candidate is included in the electoral rolls of a particular unit of Lahore, he is eligible for election.
