Due to the fact that the performance of the contract does not justify the action of the suit, the color of the suit can be considered different and the nature of the suit will, however, be different from where the cause of action was changed. That was prayed for different or additional relief. Based on the same cause of action as in the previous case, the suit's color will not be considered changed to suit the specific performance of the contract by changing the suit by a High Court order. As such, such modifications were not allowed to guarantee interference.
