ALI NAWAZ versus STATE
Pakistan Penal Code Section 307/368/344/147/148/149 West Pakistan Arms Ordinance (XX of 1965), Criminal Procedure Code (V9 1898), Trial of Section 561A, is pending against the accused. ? In 1989, the witness was quoted as saying that he was a police officer who did not appear even on the same day of the hearing, despite the stringent action against him, the result being that the trial court thereafter sought his attendance. Did not justify the issuance of a guaranteed warrant. The trial court was instructed to record the circumstances of the accused under the circumstances under Section 3434, CRPC and to give them the opportunity to examine themselves under oath under section 4040 ((?), CRPC) and if required. Lead the defense and then decide. The case on merit was dealt with accordingly.
