MUHAMMAD BAKHSH versus MUHAMMAD SHAFI
The Limitation Act (IX of 1908), Article 125 of the Constitution of Pakistan (1973), Article 85 (3) were approved by the decree-holder in order to waive the suit in the possession of the limited owners in 1949, while retaining their rights. The lawsuit was filed by the nullifier for the declaration. Saying with confession, the plaintiff's case was not binding, after the High Court properly decided such a case, the leave to appeal was denied in the circumstances.
