The West Pakistan WAPDA (Water Wing) Service of Engineers Rules, 1968 R 5 (2) (a) (ii) being a diploma holder in the drafting and designing of the Constitution of Pakistan (1973), Article 1212, refused to be developed on this basis. The case of the Tribunal respondents, thus, considered the qualifications of all the other engineers to be different from the fitness which the selection board or the departmental nalal publicity committee would consider on the basis of the complete service record and overall performance of the concerned officer.
