BASHIR AHMAD KHAN versus AZAD J & K COUNCIL
Articles 44 and 43 (2A) of the Azad Jammu and Kashmir Interim Constitution Act of 1974 (as amended by the Azad Jammu and Kashmir Interim Constitution (Amendment) Act (XX of 1993)), the Azad Jammu and Kashmir Courts and Rules Code, 1949, Section 5 (1A), in consultation with the acting Chief Justice of the Azad Jammu and Kashmir High Court, suspended the appointment of a High Court Judge, allowing him to hold public office as a High Court Judge. The validity of the act, including the drawing, therefore, was not open to challenge by a panel of persons of their rank, as judges of the High Court, There can be no justification for which law he holds as a High Court Judge under his authority.
