MUHAMMAD SHARIF versus STATE
Criminal Code of Conduct (CCPC) Sections 173 and 561 Crimes of Adultery (Enforcement Hood) Ordinance (VII of 1979), Constitution of Sections 10 and 11 of Pakistan (1973), Article 185 (3). PS and A agreed with the final finding of the police report under section 173 with the section Finding Magistrate, the CCP acquitted the accused, and the enforcement of adultery against them (Enforcement Ahad). The case was dismissed under sections 10 and 11 of the Ordinance 1979. CRPC, in exercise of its discretion under Section 616161A, revoked these orders for discharge by the magistrate on the basis that, after careful analysis, it agreed or disagreed with the contradictory recommendations of the investigating officers. Should have passed the final order. , But it (the magistrate) accepted the report of the last investigating officer through short orders, without taking any such course which did not meet the requirements. The law was appealed to examine whether the High Court was allowed to reject the magistrate's unclean orders on the grounds stated above.
