BAZ MUHAMMAD versus ZELEKHA
Code of Conduct 1908 Section 12 (2) Constitution of Pakistan (1973), Article 185 (3) Ex parte Decision in which the respondents challenged on the basis of fraud and misrepresentation, appealed to the Ex partement High Court in favor of the applicants. The respondents of the Sixth Tho Supreme Court filed a petition under section 12 (2), CPC, for reversing the previous judgment and the impugned verdict in the case which was not a party to the case, whose hearing was fraudulent and inaccurate. The statement was dismissed by the trial court. The same and directed the trial court to process the respondents' request under section 12 (2), as per CPC law, such order was affirmed by the High Court. The litigation, refusal to appeal, the application under section 12 (2), may be filed before either the Supreme Court or the High Court, declaring the matter in its jurisdiction. Went on and that the trial court had no jurisdiction to retain the application under section 12 (2), the leave of the contentious appeal from the CPC dispute raised by the applicants was granted.
