DUR-E-SAMEEN versus SELECTION COMMITTEE

On the basis of the parent certificate of the Constitution of Pakistan (1973), Article 185 (3), petitioner's admission to the admission committee was issued to the admission committee of medical college 10 6 1975 against one of the reserved seats for the District 6, inquiry. On the basis of the petitioner's father was not a resident of District Lee / District but he was able to obtain a Domicile Certificate from this district, on the basis of such inquiry, the High Court searched the Admissions Committee on the basis of record. Was confirmed. Earlier available evidence suggests that the applicant was neither permanently resident in the \ le \ district nor obtained the correct residential HC, while also accepting such disclosures. The applicant's resident \ le record was not available on the district record. The applicant's intention was to make Lee \ District a permanent home, the fact that the applicant's father had joined the service in this district was the final proof of his intention to settle permanently in the Li ict District. In order to achieve the choice of housing, permanent or indefinite housing must be planned for this change to take effect. The residence in the District was a contentious question of fact, after which, the High Court in exercising its constitutional jurisdiction generally would not consider the High Court to decide that the applicant was not eligible for a specific seat for the district concerned. But the appeal was denied.
