MUSHTAQ AHMAD versus THE STATE
Accused in his lengthy statement given under Section 2342, Pakistan Panel Code Section 494, praised Part I, the PC confessed to all the relevant facts of the case, the prosecution has alleged, except the accused. In the circumstances of the case it was not fitting that the manner in which the victim was targeted by the commission of the crime given by him was not supported by the location, location and direction of the accused. It cannot be stated on any other assumption. The deceased was shot by someone else and in the facts of the case it could only be the accused and no one else could be convicted.
