KHAWAR MUNIR DAR versus DIRECTOR-GENERAL, EXCISE AND TAXATION, PUNJAB
Before the dismissal of the Punjab Service Tribunals Act 1974 Section 4 Constitution of Pakistan (1973), Article 1212 Service of Departmental Appeal was dismissed before the Tribunal Bench comprising the Chairman of the Service Tribunal, a member of the Service Tribunal's decision. The position was challenged by a member of the service tribunal who had recorded the decision by the retiring member before retiring and joined his signatures on the same day, however, on the same day when he gave the verdict. So, according to that date it was announced. As of the date of the declaration of judgment, the retired member is not a member of the service tribunal, therefore, it cannot be considered that the tribunal petition for leave of appeal was converted into appeal and the appeal was dismissed. The case was remanded to a service tribunal for rehousing.
