MUHAMMAD ABBAS ALAM versus DIRECTOR OF EDUCATION (ELEMENTARY), LABOUR DIVISION
General Clause Act 1897 Section 21 Constitution of Pakistan (1973), Article 199 Constitution Petition The result of the applicant's CT class examination was withheld by the non-governmental education on the ground that he was underage. The applicant claimed that although he was 18 years of age and required 9 months of experience as per the test condition, the applicant's experience after attaining the age of 18 was not 9 months. Regarding age and experience, were independent and separate and had to be fulfilled by the candidate Petitioner fulfilled both the conditions and the fact was accepted by the District Scrutiny Committee that the applicants had more than 9 months of teaching experience and relevant time. I was over 18 years of age. The admission rules for the CT exam did not give the applicant / candidate this condition. Applicants should have nine months of experience after the age of 18, however, all these conditions Was accepted upon completion and was qualified by the Scrutiny Committee to participate in the examination. Was issued and allowed to participate in the examination by the Directorate of Education Directors / its officials, stating that the applicant was also on CT rule on the principle of folk punctuality. Not able to attend, the education system could not hold back their steps. Education was instructed to declare the applicant as a result of the CT class examination in 1991.
