MUHAMMAD BASHIR versus STATE
The Criminal Code of Conduct (CCPC) Section 9439 Constitution of Pakistan (1973), Article 185 (3), allowed leave of appeal to consider the argument that the accused was charged under section 439 (2), CRP. Due consideration under C was not given an appropriate hearing opportunity. When his appeal was dismissed with time restriction and he was convicted by the Sessions Court and sentenced to two years, the criminal appeal filed by the accused was found in Section 439 (1), Under CRPC, criminal prosecution could be declared. 9439 (Cr), there was no restriction in the PC and that the courts did not examine the evidence in accordance with the principles prescribed by the Supreme Court for the administration of criminal justice.
