JAM MASHOOQ ALI versus SHAHNAWAZ JUNEJO
Representation of Section 62 of the Public Act 1976 (as amended by the Public Representation (Seventh Amendment) Ordinance (XXIV of 1985)), Section 64 Election Request Procedure for Election Petition Trial and Amendment of Section 62 Rule Subsequent to the amendment to the Regulation, regulated by the Civil Procedure, applicable section 62 of 1908, the Representation of the People Act, 1976, and after the amendment, it was indicated that the legislature intended to hear election requests. That they read the long procedure prescribed under the Civil Code, Article 62, the amendment of the Act and the possible harmony in Section 64 64 Interpretation whereby the Election Tribunal may have all the powers of the Civil Court under the CPC, except for the trial of election petitions, wherein the procedure set by the Election Commission for the formation of matters presented by the Election Tribunal Party Commission However, the Election Tribunal did not have the law required or facilitated a proper election petition and bringing controversial points to the parties could attack the resolution of the dispute when matters are not settled. The parties were not shown any prejudice due to the formation. The points raised in the election petition were properly contradicted in the written statement and the evidence presented by the parties was legally recorded by the Election Tribunal; the decision made without framing the cases was not considered illegal by the applicant. However, neither in the written statement nor in the trial petition has there been any objection to the disapproval of the matter in the election petition.
