NIAZ MUHAMMAD ALIAS NIAZI versus THE STATE
The decisions and duties of the Referee Judge, Section 378 and 429 of the Code of Criminal Procedure, when a judge is referred to a trial decision, will independently review the evidence and formulate their opinion on it. The matter will not be re-sent to the division. The Bench that heard it and the decision will not be majority, but it will be the opinion of the referee judge which will have a decisive effect and will be binding and the decision or ruling will be followed by such opinion.
