HAZARA PUNJAB COAL CO. versus DIRECTOR OF INDUSTRIES AND MINERAL DEVELOPMENT, PUNJAB, LAHORE
Punjab Mining Concession Rules 1986 Section 35 Constitution of Pakistan (1973), Article 185 (3), rejecting the applicant's request to convert the mineral license into a lease, was denied. The constitutional petition was dismissed by the High Court. On the basis that disputed matters were beyond the scope of constitutional jurisdiction in this case, the endorsement applicant failed to show the authority during his entire license: he successfully discovered coal from a licensed area of Petitieur's claim. , That at the end of its licensing period, it had discovered black shale (coal dust), which signified the fact that coal was found in the area, and the proof of the claim concerns mining. None of the mining engineer's reports were supported. The discrimination license was issued to lease the area on successful exploitation / exploration of the area where, even after the legal term of such licensors, the satisfaction of the leasing authorities for five years could not be proved. The efforts were fruitful, then there was no basis for granting lease rights through the authority; no matter for leave permission was made, the appeal was denied.
