HASSAN ASSOCIATES versus PAKISTAN TELECOMMUNICATION CORPORATION
Article 2 (h) of the Contract Act 1872 Constitution of Pakistan (1973), Article 199 Constitutional plea agreement between the parties under which the applicant will provide certain services for breach of contract. Where there was a breach of contract, it was not dealt with under the constitutional jurisdiction of the High Court. In the case of disagreements between the parties, the dispute had to be sent to the arbitrator, whose decision was final and binding on the parties, as the applicants had other remedies. In addition to some factual disputes in filing a lawsuit for a civil court order; a suit for damages; and for the specific performance of the contract, the constitutional request was not a proper request, which the applicant sought to highlight in his complaint to the Director, the Federal Investigation Agency. After the petition was transferred, such fact would prevent it from taking extraordinary constitutional jurisdiction. In all higher case cases, where the execution of a civil contract was involved, no writ can be issued to enforce constitutional jurisdiction. Applicants have alternative remedies available for their implementation of the contract ban. The constitutional request was not maintained.
