KHOBAN versus STATE
The accused was arrested on the spot and taken to the police station, as well as the recovery of large quantities of weapons, if any, on the basis of appreciation of the provisions of Sections 13 and 14 of the West Pakistan Arms Ordinance 1965. It could not be said that the delay was used by the prosecution to get the accused involved in the case, that the judicial confession made by the accused was voluntary and the alleged delay in doing so did not prove on record. The evidence used to extract the crime was contradictory, and the police did not receive any confidence. It cannot be assumed that he had purchased such a large amount of weapons to falsely implicate the accused in the case, and the convictions sent to the accused by the trial court have been retained.
