M. ASLAM AMIN versus MUHAMMAD ALI KHAN
Sections 30 and 33 of the Arbitration Act 1940 keep the award separate A general rule award shall be final for both fact and law, but where any error of law is expressed in the face of the award, it is a separate one to keep it Ground. However, there was another rider besides the general rule that if the parties specifically cited arbitration on any question of law, the general rule would have been applicable and the award would have been reprehensible if such question was wrongly decided. So as a general arbitrator, the principle has always been considered as an option to follow the general principles of law, so deliberate disregard of the law would result in such misconduct by the arbitrator as to keep his award separate. Will be justified.
