TAHIR ALIAS SAIN LODHI versus STATE
Section 13 of the West Pakistan Arms Ordinance 1965, which was in police custody in connection with the murder case registered against him, took the police party to his house during interrogation and recovered a Kalashnikov witness who was a police officer. Was examined at length, nothing was brought on record to suggest that the suspect was not in police custody or had no recovery effect at the time of Kalashnikov's recovery. Could not bring enmity or intention under which he had wrongly involved the manager. There was no doubt that the witnesses who did cross-examination were true witnesses and could be safely counted on. The police did not raid the house nor came there for the purpose of searching. That the absence of witnesses from the public would not be fatal.
