MUHAMMAD TARIQ KHAN versus MUHAMMAD SHARIF KHAN SHINWARI

Article 17 Constitution Pakistan (1973), Article 185 (3) of the Cantonment Rent Restriction Act, 1963, used the eviction of tenants as a hotel or restaurant, while making their departure mandatory. Such a tenant had two years' notice before moving the application for. No such notice was given by the landlord in writing to the tenancy agreement, however, there is no provision that the parties will be bound by the terms of such written agreement and in the term of the lease. There will be no further extension and the landlord will be free. When the tenancy period ends, initiate legal proceedings against your tenant. The question is whether such terms contained in the tenancy agreement will be for the notice under section 17, the Cantonment Rent Restriction Act, 1963, which requires consideration. So also the question of whether the applicants are not party to the petition, as well as the order passed on the same holiday in which the appeal was allowed to determine such questions.
