MUHAMMAD RAFIQUE versus DEPUTY COMMISIONER, ABBOTTABAD
Para 6 and 7 Constitution of Pakistan (1973), Article 185 (3) Applicants' queries on the transfer of shops were properly complied with the remand approved by the High Court by the Additional Settlement Commissioner. Whether there were shops / available property in the possession of the applicants and the applicants were entitled to transfer the shops under the scheme. Whether the property identified in the site plan was actually transferred to the defendant and whether he was entitled to the transfer. And even though the interim transfer order submitted by the respondents to the Additional Settlement Commissioner during the trial was not a fake document, it never saw the light before it was presented.
